Haulit Equine Terms and Conditions Platform

Welcome to Haulit Equine. These Unified Terms (“Terms”) govern your use of the Haulit Equine mobile application, website, and any services offered by Haulit Equine L.L.C. (“Haulit Equine,” “we,” “us,” or “our”).
By accessing or using the platform, you agree to these Terms. If you do not agree, discontinue use immediately.

1. Platform Overview

Haulit Equine is a peer-to-peer (P2P) equine transport platform connecting customers needing horse transport with independent, verified haulers (Haulers).
Haulit Equine acts solely as a technology facilitator and is not a carrier, broker, employer, or agent of any user.
All transport services are performed by independent third-party Haulers.

2. User Eligibility & Age Requirements

· Users must be 18 years or older to create an account.

· Haulers performing interstate transport must be 21+ per FMCSA regulations.

· Intrastate drivers using this platform must also be 21+ to maintain consistency and safety requirements.

3. User Responsibilities

For Customers

Customers must provide accurate, complete details including:

· Pickup & delivery addresses

· Horse breed(s), number, temperament, medical considerations.

· Any required feeding, watering, rest, or specialty instructions.

· Valid Coggins and interstate health certificates when required.

Horses must be healthy, fit for travel, and safe to load.

For Haulers

Haulers must:

· Maintain a valid driver’s license or CDL (if applicable)

· Maintain USDOT and MC numbers where legally required.

· Maintain all applicable insurance (commercial auto, cargo/livestock, general liability; CCC recommended)

· Maintain compliant equipment (ventilation, flooring, safety devices)

· Abide by USDA, FMCSA, Clearinghouse, and state transport regulations.

· Never provide falsified, expired, or fraudulent credentials

Haulit Equine is not responsible for tracking or reminding users of credential expirations.

4. Hauler Credentialing, Vetting & Compliance

Haulit Equine uses Checkr and integrated DOT/MVR to verify:

· Driver identity

· DOT/MC authority

· CDL or license status

· Insurance documentation

· Clearinghouse enrollment

· Background checks

· Bi-annual MVR checks

Haulers must update any revoked or expired credentials promptly.

5. FMCSA ELD & Hours-of-Service Compliance

Haulers are solely responsible for determining whether FMCSA ELD and RODS requirements apply to their operations.

ELD Required When:

· Operating in interstate commerce, and

· Required to maintain Records of Duty Status under FMCSA regulations.

ELD Exemptions Include:

· Operating within 150 air-mile radius and returning to the same location within 14 hours

· Using paper logs 8 or fewer days in any 30-day period

· Fully intrastate hauling (subject to state rules)

Haulit Equine provides trip-tracking tools for coordination only-not FMCSA-certified ELD devices.

All Haulers must complete an annual Hauler Attestation acknowledging their regulatory responsibilities.

6. Payments, Fees & Taxes

Customers

Haulit Equine retains:

· 5% service fee on total transport costs up to $5,000

· 3.5% service fee on amounts over $5,001

· Haulit Equine applies a 5% service fee on all transactions until the cumulative fee amount reaches the equivalent of a 3.5% service fee on the total haul cost. Once the 5% calculated fee equals the 3.5% threshold, the service fee is capped and does not increase further.

Payments are processed through Stripe Express/Connect and held in escrow until delivery is confirmed.

Haulers

· 30-day free trial

· $10/month platform subscription afterward

· Checkr verification fee deducted from first haul

· Payouts typically released within a reasonable timeframe, usually 2 business days.

Taxes

· Haulers are independent contractors

· Haulit Equine does not withhold or remit taxes

· Stripe may issue 1099-K forms per federal thresholds

7. Refunds & Cancellations

· Full refund if a haul is canceled before travel begins.

· If the trip cannot be completed due to illness or emergency, refunds may be issued minus incurred travel costs.

· All refunds follow Haulit Equine's published Refund Policy.

8. Insurance & Liability Disclaimer

Haulit Equine does not provide insurance for:

· Horses

· Vehicles

· Haulers

· Equipment

· Customers

· Cargo

Customers

Responsible for securing equine mortality/injury insurance if desired.

Haulers

Must maintain:

· Commercial auto

· Cargo/livestock coverage

· General liability

· CCC coverage strongly recommended

Haulit Equine assumes no liability for injuries, accidents, damages, or losses.

9. GPS Tracking, Digital Documentation & Trip Data

By using Haulit Equine, users consent to:

· GPS tracking during active hauls

· Collection of trip telemetry for ETAs, safety, and dispute resolution

· Storage of route and timestamp data

Every haul includes a digital Bill of Lading (BOL) used as legal proof of pickup, transport, and delivery.

10. Independent Contractor Acknowledgment

Haulers are independent contractors, not employees or agents of Haulit Equine.
Nothing in these Terms creates:

· Employment

· Partnership

· Joint venture

· Agency relationship

Haulers are solely responsible for:

· Taxes

· Insurance

· Licenses

· Vehicle condition

· Compliance with law

11. Account Suspension, Termination & Reinstatement

Haulit Equine may suspend or terminate accounts due to:

· Expired credentials

· Insurance lapses

· Failed background checks

· Fraud

· Unsafe behavior

· Animal-welfare violations

· Chargebacks

· Haulit Equine discretion

Haulers may request reinstatement within 14 days with updated documents.

12. Animal Welfare, Safety & Compliance

Haulers must maintain:

· Safe, ventilated trailers

· Emergency markers and fire extinguisher

· Appropriate flooring, partitions, and restraints

Customers must ensure:

· Horses are physically fit to travel

· All temperament/medical disclosures are accurate

Haulit Equine may suspend users for unsafe or inhumane practices.

13. Privacy, Data Use & Security

Haulit Equines collects:

· Personal information

· GPS data

· Payment data through Stripe

· Communications

· Trip history

Data is encrypted, access-restricted, never sold, and used only for platform operation, safety, compliance, and fraud prevention.

14. Platform Access, Availability & Connectivity

· Service interruptions may occur due to maintenance or network issues.

· Availability is not guaranteed.

· Users are responsible for adequate cellular and GPS connectivity.

15. Geographic Availability

Haulit Equine is currently in limited beta release within Michigan.

16. Intellectual Property

All content, logos, code, trademarks, and media on Haulit Equine belong exclusively to Haulit Equine L.L.C.
Unauthorized use is strictly prohibited.

17. Force Majeure

Haulit Equine is not liable for delays resulting from events, including but not limited to:

· Natural disasters

· Severe weather

· Acts of God

· War, civil unrest

· Government actions

· Labor disruptions

· Infrastructure failure

· Supply chain breakdown

· Civil demonstrations and protests

18. Limitation of Liability

Haulit Equine functions strictly as a technology platform.

Haulit Equine is not liable for:

· Injuries

· Death

· Property loss

· Horse injury or death

· Financial losses

· Equipment failure

· Negligence of users

Users agree to indemnify and hold Haulit Equine harmless from all claims.

19. Dispute Resolution, Arbitration & Legal Jurisdiction

All disputes, including wrongful death or serious injury claims, must be resolved through binding arbitration.

Arbitration Terms:

· Administered by the American Arbitration Association (AAA)

· Conducted per Michigan law

· Panel of three arbitrators

· Venue: Grand Rapids, Kent County, Michigan

· Users waive the right to litigate in court or participate in a class action

20. Reservation of Rights

Haulit Equine may update these Terms at any time.
Continued use of the platform constitutes acceptance of the revised Terms.
