Haulit Equine Terms of Service

Welcome to Haulit Equine
These Terms of Service (“Terms”) govern your use of the Haulit Equine mobile application, website, and platform operated by Haulit Equine L.L.C. (“Haulit Equine,” “we,” “us,” or “our”). By accessing or using the platform, you agree to these Terms. If you do not agree, discontinue use immediately.
1. Platform Overview
Haulit Equine is a peer-to-peer (P2P) marketplace connecting horse owners needing transport with verified, independent haulers. Haulit Equine acts solely as a technology facilitator, not as a carrier, broker, or employer. All transport services are performed by independent third-party drivers (“Haulers”).
2. User Eligibility and Age
All users must be at least 18 years old to create an account. Drivers engaging in for-hire interstate transport must be at least 21 years old per FMCSA federal regulation. Intrastate hauls must meet the applicable state minimum age (typically 18+).
3. Driver Credentialing and Compliance
Drivers must maintain compliance with all applicable laws and these platform requirements:
Required:
- Valid Driver’s License / CDL (if applicable)
- Active USDOT Number and, where required, MC Number
- Enrollment in and compliance with FMCSA Clearinghouse regulations
- Current commercial auto and general liability insurance meeting or exceeding FMCSA minimums
- Proof of insurance on file with Haulit Equine
- Participation in bi-annual MVR (Motor Vehicle Record) checks
Haulit Equine verifies these items through Checkr and integrated DOT/MVR APIs during onboarding and every 6 months thereafter. Drivers must immediately update expired or revoked credentials. Failure to maintain valid records may result in suspension.
4. Payments, Fees & Taxes
Customers:
Haulit Equine retains a 5% service fee on hauls up to $5,000, and 3.5% fee above $5,001. All payments are processed securely via Stripe Express and held in escrow until confirmed delivery.
Drivers:
New drivers receive a 30-day free trial, then pay $10/month for platform access. Onboarding background verification (Checkr) is recovered automatically from the first completed haul. Driver payouts are released within 1–2 business days after confirmed delivery. Haulit Equine partners with Stripe Express for all payouts and 1099 tax reporting automation. Drivers consent to Stripe’s connected-account terms and must complete tax onboarding before receiving payments.
Taxes:
Drivers are independent contractors and are solely responsible for reporting income and remitting all federal, state, and local taxes.
5. Insurance & Liability Disclaimer
Haulit Equine does not provide insurance coverage for horses, vehicles, or transport.
Customers are responsible for obtaining equine mortality or injury insurance. Drivers must maintain required commercial auto and cargo policies and are encouraged to obtain Care, Custody & Control (CCC) coverage.
Haulit Equine assumes no liability for loss, injury, or damage to persons, property, or livestock. Users agree to hold Haulit Equine L.L.C. harmless for all claims arising from transport activities.
6. GPS Tracking & Trip Data
By using Haulit Equine, you consent to:
- GPS location tracking during active hauls;
- Collection and processing of trip telemetry for safety and ETA accuracy;
- Storage of route data for compliance and dispute resolution.
Haulit Equine uses GPS solely to provide real-time tracking and safety visibility. Data is encrypted and retained only as required by law or regulatory audit. Failure to activate GPS during an active trip may delay or void payout eligibility.
7. Digital Documentation
Each trip includes a digital Bill of Lading (BOL) confirming pickup, route, and delivery details. Both parties agree the digital BOL serves as legal acknowledgment of shipment terms and proof of delivery.
8. Independent Contractor Status
Drivers acknowledge they are independent contractors, not employees or agents of Haulit Equine. They are solely responsible for maintaining insurance, permits, and records, as well as for vehicle condition, compliance, and tax obligations. Nothing in these Terms creates an employment, agency, or partnership relationship.
9. Account Suspension & Termination
Haulit Equine may suspend or terminate any account for expired credentials or insurance, failed background checks, violation of animal-welfare or safety standards, or fraudulent activity. Drivers may request reinstatement within 14 days by submitting updated documentation for review.
10. Refund & Cancellation Policy
If a confirmed haul cannot be completed and travel has not begun, customers receive a full refund. Once pickup travel is initiated, refunds are prorated minus verifiable driver expenses.
11. Privacy & Data Use Policy
Haulit Equine collects and uses personal information (e.g., names, addresses, payment data, GPS, communications) to facilitate bookings and payments, enhance safety and compliance, and prevent fraud. Haulit Equine does not sell personal information. Data is encrypted, access-controlled, and retained only for business or legal compliance. Use of the platform constitutes consent to our Privacy & Data Use Policy available at https://haulitequine.com/privacy.
12. Safety, Animal Welfare & Compliance
All users must adhere to federal and state laws governing animal transport, including USDA interstate health requirements, humane handling, and rest intervals. Drivers must maintain safe trailers with proper ventilation and flooring, carry emergency reflectors and fire extinguisher, and log delays and animal checks in-app. Customers must ensure horses are fit for travel and provide accurate handling information.
13. Dispute Resolution & Arbitration
All disputes shall be governed by Michigan law. Users agree to first attempt resolution through Haulit Equine support. If unresolved, disputes will be settled by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Rules. Arbitration may occur virtually or in Michigan by mutual agreement. Users waive participation in class-action or collective proceedings.
14. Platform Access, Downtime & Maintenance
Haulit Equine may suspend access temporarily for system maintenance, upgrades, or security reasons without liability. Availability is not guaranteed, and Haulit Equine is not responsible for interruptions due to third-party networks or service providers.
15. Driver Vetting & Education
Haulit Equine maintains a Driver Vetting Checklist integrated into the admin dashboard and provides an online Driver Education & Compliance Resource Center.
16. Insurance Coverage
Haulit Equine maintains Errors & Omissions (E&O) and Platform Liability Coverage for operational protection. This coverage does not extend to users, drivers, or transported animals.
17. Reservation of Rights
Haulit Equine may modify these Terms at any time. Continued use after updates constitutes acceptance of the revised Terms.
